Terms and Conditions of Sale

Definitions
“The company POLIMAIR”: refers to the company POLIMAIR, a simplified joint-stock company with a capital of 27,286 euros, registered with the Paris Trade and Companies Register under number 919 649 731 and whose registered office is located at 24 rue Muller – 75018 Paris.
“Client”: refers to the natural or legal person who has created an account on the Website and orders a Product as a consumer.
“General Terms and Conditions”: refers to these general terms and conditions of sale defining the terms and conditions for the sale of Products to the Client by the company POLIMAIR.
“Products”: refers to the products offered for sale and sold by the company POLIMAIR on the Website.
“Website”: refers to the POLIMAIR company website available at https://www.polimair.fr/.
Preamble
The company POLIMAIR creates and markets high-quality durable products, primarily using recycled materials, on its website https://www.polimair.fr/. The list of products sold and available can be consulted on https://www.polimair.fr/.
Article 1 | Purpose and general provisions
These terms and conditions of sale aim to define the contractual relationship between the company POLIMAIR and the Client and the conditions applicable to any purchase made through the website https://www.polimair.fr/.
At the time of purchase, the Client declares having read the general terms and conditions of sale and accepts them without restriction or reservation by checking a box with a validation click.
The Client declares to have full legal capacity, allowing them to commit under these general terms and conditions of sale.
The company POLIMAIR reserves the right to modify these general terms and conditions of sale at any time, in order to comply with any new regulations or with the aim of improving the use of its site. As a result, the applicable conditions will be those in force on the date of the Client's order.
Article 2 | Products
The products offered are those listed on the website https://www.polimair.fr/, within the limits of available stock. The company POLIMAIR reserves the right to modify the product assortment at any time.
Each product is presented on the website in the form of a description detailing its main technical characteristics. The photographs are as faithful as possible but do not bind the seller in any way.
The sale of the products presented on the site is intended for all Clients residing in countries that fully authorize the entry of these products into their territory.
Article 3 | Product Customization
The company POLIMAIR offers the Client the possibility to customize the colors of the products they wish to order on the Website.
Article 4 | Prices
The prices listed on the product sheets in the online catalog are in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products.
The company POLIMAIR reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the Client.
The prices indicated do not include delivery costs, which are invoiced in addition to the price of the purchased products according to the total amount of the order. Shipping costs are indicated at the time of the order in euros (€) all taxes included (TTC).
Article 5 | Payment Methods
All orders are payable in full by the Client. To pay for their order, the Client has the following payment methods:
- Bank card: Visa and Master Card
- ApplePay
The communication by the Client of their bank card number constitutes authorization to debit their account for the amount of the order. Any order with bank card payment is only considered effective when the relevant payment centers have given their approval.
Online payment is made through the secure Stripe system.
Article 6 | Online Contract Conclusion
The Client must follow a series of specific steps for each product offered by the seller to place their order:
- Selection of the Product, if applicable its options, and essential Client data entry;
- Acceptance of these General Terms and Conditions of Sale;
- Verification of the order details and, if necessary, correction of errors;
- Following payment instructions and payment for the products;
- Delivery of the products.
The Client will then receive email confirmation of the payment for the order, as well as an order acknowledgment confirming it.
Article 7 | Retention of Title
The company POLIMAIR retains full ownership of the sold products until full payment of the price, including principal, costs, and taxes.
Article 8 | Delivery
Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. The usual delivery time is 6 to 8 weeks from the order confirmation. This period is indicative and may vary depending on the product and the chosen options.
The company POLIMAIR may provide the Client with the tracking number for their package by email.
The Client is required to check the condition of the packaging of the goods and their contents upon delivery in the presence of the delivery person. In case of damage during transport, any complaint must be made to the carrier within three days from delivery.
Article 9 | Warranty
9.1 Legal guarantee of conformity
All products supplied by the company POLIMAIR benefit from the legal guarantee of conformity provided for in articles L217-4 et seq. of the Consumer Code. In the event of a lack of conformity, the Client has two (2) years from delivery to act.
9.2 Legal guarantee against hidden defects
Products also benefit from the legal guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code.
9.3 POLIMAIR Lifetime Commercial Warranty
In addition to the legal guarantees, the company POLIMAIR grants a lifetime commercial warranty on all its products against breakage that renders the product non-functional. This warranty does not cover scratches, discoloration, or natural aesthetic changes of the product, nor damage resulting from misuse, incorrect assembly, or accident.

Article 10 | Right of Withdrawal
Pursuant to Article L221-18 of the Consumer Code, the Client has a period of fourteen (14) days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty. However, the return costs will remain entirely at the Client's expense.
In accordance with Article L221-28, 3° of the Consumer Code, the right of withdrawal does not apply to personalized products manufactured according to the Client's specifications, particularly those ordered with a custom color or any other non-standard catalog customization.
Article 11 | Product Return Procedure
The Client must exercise their right of withdrawal:
- either by duly completing the withdrawal form provided in the appendix;
- or by duly completing the withdrawal form available in your account (under "my orders");
- or by mail, attaching a copy of their invoice, to the following address:

POLIMAIR's after-sales service undertakes to contact the Client within 72 hours to detail the product return procedure.
The Client must return the products in their original packaging and in perfect condition. Returns will only be accepted if the product return procedure is followed by the Client.
Article 12 | Product Exchange and Refund
1. Product Exchange
If the Client wishes to exchange products, returns will only be accepted by the company POLIMAIR if the return procedure described in Article 11 above is duly followed. New products will be delivered to the Client within a reasonable timeframe.
2. Product Refund
When the right of withdrawal is exercised, the company POLIMAIR undertakes to refund the Client within fourteen (14) days following the date of receipt of the returned product, provided that it is in good condition and complies with the return conditions described in Article 11.
Any product damaged by the Client will not be refunded.
Article 13 | Assembly
In the event of incorrect installation or damage to the products during assembly by the Client and/or a person of their choice, the resulting damage cannot be covered by the company POLIMAIR, which disclaims all responsibility in this regard.
Article 14 | Liability
The company POLIMAIR, in the distance selling process, is bound only by an obligation of means. Its liability cannot be engaged for damages resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.
Article 15 | Intellectual Property
The content of the site (texts, logos, graphic and/or sound images, etc.) is the property of the company POLIMAIR and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.
Article 16 | Personal Data
The company POLIMAIR undertakes to preserve the confidentiality of the information provided by the Client. The personal data collected is processed in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and amended Law no. 78-17 of January 6, 1978.
The data controller is the company POLIMAIR, SAS, 24 rue Muller, 75018 Paris.
In accordance with current regulations, the Client has the right to access, rectify, delete, object to, restrict, and port their data. In case of a complaint, the Client can contact the CNIL (www.cnil.fr). These rights can be exercised at the following address: contact@polimair.fr.
Article 17 | Dispute Resolution
These distance selling conditions are subject to French law. In the event of a dispute, and in accordance with Article L616-1 of the Consumer Code, the Client may free of charge use the consumer mediator of the FEVAD (Federation of e-commerce and distance selling) — 60 rue La Boétie, 75008 Paris — www.mediateurfevad.fr.
For all disputes or litigation not resolved by mediation, the competent court will be the Court of PARIS.
